1. Introduction
Welcome to EMIL Health. These Terms and Conditions ("Terms") govern your access to and use of the EMIL Health platform, including our website, marketplace, and any related services (collectively, the "Platform"), operated by EMIL Health ("EMIL," "we," "us," or "our").
EMIL is a health clarity platform. We help people understand, organize, and act on their health-related information. Our current beta product includes a pharmacy marketplace that allows users to upload prescriptions, submit medicine requests, and connect with pharmacies for order fulfillment.
By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our Platform. These Terms apply alongside our Privacy Policy, which explains how we handle your information.
2. Use of the Platform
EMIL is intended for personal, lawful use by individuals seeking to manage and understand their own health-related information. You agree to use the Platform only in ways that are consistent with these Terms and applicable law.
Eligibility
You must be at least 18 years of age to use EMIL. By using the Platform, you confirm that you meet this requirement. If you are using EMIL to manage information on behalf of a family member or dependent, you confirm that you are authorized to do so.
Accuracy of information
You agree to provide truthful, accurate, and complete information when using EMIL — including when uploading prescriptions, entering medicine requests, or providing contact and delivery details. Providing false or misleading information, particularly in a healthcare context, can have serious consequences. EMIL is not in a position to independently verify all user-submitted information, and the quality of service depends on what you provide.
Permitted use
- Using EMIL to understand and organize your own health records and prescriptions.
- Placing legitimate medicine orders through the marketplace for personal use.
- Sharing appropriate health information with pharmacies through EMIL to facilitate an order.
Prohibited use
- Submitting false, forged, or altered prescriptions.
- Using the Platform to obtain medicines for someone other than yourself without proper authorization.
- Attempting to circumvent, reverse-engineer, or disrupt any part of the Platform.
- Using EMIL for any commercial purpose without our prior written consent.
- Violating any law or regulation in your jurisdiction in connection with your use of the Platform.
3. Marketplace Role and Disclaimer
EMIL is a facilitator, not a pharmacy. We connect you with pharmacy partners — we do not dispense, handle, or fulfill medicine orders ourselves.
The EMIL marketplace operates as an intermediary platform. When you place an order through EMIL, your request is transmitted to a participating pharmacy that is responsible for reviewing, fulfilling, and delivering that order.
Pharmacy responsibilities
Participating pharmacies are independently responsible for:
- Verifying the authenticity and validity of any prescription submitted.
- Confirming that the requested medicine is appropriate based on the prescription provided.
- Dispensing medicines in accordance with applicable laws and professional standards.
- The accuracy of the medicines dispensed and the quality of the products provided.
- The delivery or fulfillment of the order, including timing, packaging, and handling.
EMIL's role
EMIL's role is limited to receiving your request, helping to structure and present the relevant information clearly, and transmitting it to the appropriate pharmacy. We do not review prescriptions for medical accuracy, verify dosage appropriateness, or make dispensing decisions.
Any dispute relating to the quality, delivery, or fulfillment of a medicine order is primarily between you and the pharmacy. EMIL will assist in facilitating communication where possible, but we are not a party to the transaction between you and the pharmacy.
4. Medical Disclaimer
EMIL does not provide medical advice. Nothing on this Platform should be interpreted as a diagnosis, treatment recommendation, or substitute for professional medical guidance.
EMIL is a health information and clarity platform, not a healthcare provider. We do not employ licensed medical professionals in a clinical capacity, and the information we surface or organize is not reviewed for clinical accuracy or safety.
Any content, interpretation, or organization of health-related information generated through EMIL is for informational and organizational purposes only. It is not intended to replace, supplement, or conflict with the advice of a qualified healthcare professional.
You should always consult a licensed doctor, pharmacist, or other qualified healthcare professional before making decisions about your health or medication. If you are experiencing a medical emergency, contact emergency services immediately — do not rely on EMIL.
5. AI and Automated Processing Disclaimer
EMIL uses automated systems, including AI-assisted tools, to help read, structure, and present health-related information submitted by users. These systems are designed to improve clarity and usability — for example, by extracting medicine names and dosage details from an uploaded prescription image.
Limitations of automated systems
- Automated outputs may not always be accurate, complete, or correctly interpreted.
- AI systems can make errors, particularly with poor-quality images, handwritten text, or unusual formatting.
- The structured output generated by EMIL should be treated as a helpful starting point, not a guaranteed accurate representation of your original document.
Your responsibility to verify
You are responsible for reviewing any information that EMIL presents or organizes on your behalf. Before confirming an order, please verify that the medicine name, dosage, quantity, and other details shown are consistent with what your prescribing professional has instructed.
EMIL does not accept liability for errors resulting from automated processing of user-submitted information where those errors arise from limitations inherent to the technology or from inaccurate, incomplete, or low-quality input.
6. User Responsibilities
Using EMIL comes with responsibilities on your side. By using the Platform, you agree to the following:
Accuracy and honesty
You will only submit genuine, unaltered prescriptions. You will accurately describe your medicine needs. You will not misrepresent your identity or the purpose of your requests.
Compliance with healthcare laws
You will only request medicines that are lawful for you to obtain in your jurisdiction. You acknowledge that certain medicines require a valid prescription and that submitting a request for a prescription medicine without one is both a violation of these Terms and potentially unlawful.
Appropriate use of outputs
You will not treat EMIL's information summaries, interpretations, or organized records as medical advice or clinical determinations. You will seek appropriate professional guidance for health decisions.
Security of your access
You are responsible for maintaining the security of any credentials used to access your EMIL account. You should notify us promptly at info@emilhealth.co if you suspect unauthorized access to your account.
7. Accounts
Certain features of the EMIL Platform may require you to create an account. When you do, you agree to provide accurate registration information and to keep that information up to date.
Your account is personal to you. You may not transfer it to another person or allow others to use it to place orders or access your health information. EMIL reserves the right to suspend or terminate accounts that are found to be misused, inactive for an extended period, or in violation of these Terms.
As EMIL is currently in beta, account features and access levels are subject to change. We will communicate significant changes with reasonable notice.
8. Limitation of Liability
To the fullest extent permitted by applicable law, EMIL's liability to you in connection with your use of the Platform is limited as follows:
Pharmacy actions
EMIL is not responsible for the acts or omissions of any pharmacy partner, including errors in dispensing, delays in delivery, product quality issues, or failure to verify a prescription. Your recourse in such matters is with the pharmacy directly.
Reliance on information
EMIL is not liable for any harm, loss, or adverse outcome resulting from your reliance on information surfaced, organized, or generated by the Platform — including outputs from automated or AI-assisted processing.
Service interruptions
EMIL is not liable for losses arising from temporary unavailability of the Platform, data loss due to technical failures, or other service interruptions beyond our reasonable control.
Indirect losses
In no event will EMIL be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Platform, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.
9. Service Availability
EMIL is currently in beta. This means the Platform is actively being developed and improved. We do not guarantee that the Platform will be available at all times, free from errors, or suitable for any particular purpose.
We may perform scheduled or unscheduled maintenance, updates, or modifications that temporarily affect access. Where possible, we will give advance notice of planned downtime.
EMIL reserves the right to modify, suspend, or discontinue any feature or part of the Platform at any time. We will make reasonable efforts to notify users of significant changes in advance, but are not obligated to maintain any specific feature or service level during the beta period.
10. Changes to Terms
We may update these Terms from time to time as the Platform evolves or as legal requirements change. When we do, we will update the "Last updated" date at the top of this page.
For material changes — those that meaningfully affect your rights or obligations — we will provide notice by email or through a prominent notice on the Platform before the changes take effect. Your continued use of EMIL after changes are posted constitutes your acceptance of the revised Terms.
If you do not agree to updated Terms, you should stop using the Platform and may request deletion of your account as described in our Privacy Policy.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which EMIL Health is incorporated, without regard to its conflict of law provisions.
If you access the Platform from outside that jurisdiction, you are responsible for compliance with local laws to the extent they apply. We make no representation that the Platform is appropriate or available for use in all locations.
Any disputes arising from these Terms or your use of the Platform that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of EMIL Health's registered jurisdiction. We will always attempt to resolve disputes directly and in good faith before any formal process is initiated.
